President Cyril Ramaphosa has officially appointed Senior Counsel Advocate Tembeka Nicholas Ngcukaitobi as an Acting Justice of the Constitutional Court. The appointment, made under Section 175(1) of the Constitution, is set to run from 1 June to 30 November 2026.

Ngcukaitobi, a highly regarded legal mind known for his extensive work in constitutional law and land reform, joins the apex court during a critical period for the South African judiciary.

His temporary elevation follows a recommendation from the Minister of Justice and is intended to bolster the court’s capacity.

Ngcukaitobi is one of South Africa’s most prominent legal practitioners.

Having earned his silk (SC) at a relatively young age, he has been involved in high-profile litigation ranging from anti-corruption cases to the landmark “State of Capture” proceedings.

He is also a celebrated author, specifically noted for his research into the history of Black lawyers and land rights in South Africa.

Section 175(1) of the South African Constitution allows the President to appoint acting judges to the Constitutional Court if there is a vacancy or if a sitting judge is absent. This ensures that the court maintains a quorum (the minimum number of judges required to hear a case), which is essential for the timely delivery of judgements.
